These General Terms and Conditions (AGB) apply to all contracts concluded between Carwashh Shop GmbH (hereinafter referred to as "we", "us", or "carwashh.shop") and the customer (consumer or commercial business) for car wash, valeting, paint correction, interior detailing, and ceramic protective coating services booked online via www.carwashh.shop, by telephone, or in person at our Berlin premises.

§ 2 Appointment Reservation & Contract Formation
- The presentation of detailing packages and pricing on www.carwashh.shop constitutes an invitation to treat (invitatio ad offerendum) and is not a legally binding offer.
- By submitting the online booking form on carwashh.shop/booking, the customer issues a binding request to reserve a workshop detailing bay.
- The contract is concluded when we confirm the appointment in text form (via email or SMS booking confirmation voucher) containing the assigned reservation code.
§ 3 Vehicle Handover & Initial Condition Inspection (Übergabeprotokoll)
Upon vehicle arrival at our Berlin Detailing Studio (Tempelhofer Weg 42–44, 10829 Berlin), a joint pre-wash visual inspection is conducted. Existing dents, deep stone-chips, severe wheel curb rash, cracked glass, or interior tears are documented in an electronic condition protocol (Übergabeprotokoll).
§ 4 Prices and Terms of Payment
- All prices quoted on www.carwashh.shop are in Euro (€) and include the statutory German Value Added Tax of 19% (Mehrwertsteuer - MwSt.).
- Vehicle category surcharges apply according to vehicle length, height, and surface area (Compact, Sedan, SUV, Van, Supercar).
- Payment is due upon completion of services and vehicle pick-up. Accepted methods: EC-Karte / Girocard, Credit Card (Visa, Mastercard, Amex), Apple Pay, Google Pay, or Cash. Fleet clients may pay via SEPA invoice with prior written credit approval.
§ 5 Cancellation and Rescheduling Policy
We reserve workshop space, specialized infrared curing equipment, and technician hours specifically for your appointment:
- Free Cancellation: You may cancel or reschedule your reservation free of charge up to 24 hours prior to your scheduled time.
- Late Cancellation / No-Show: In the event of a cancellation less than 24 hours prior to the slot, or failure to attend without notice, a compensatory reservation fee of 50% of the booked service total may be levied (§ 642 BGB), unless the customer demonstrates that no damage or significantly less damage occurred.
§ 6 Pickup and Default of Acceptance
The customer is notified via SMS/email upon completion of the detailing treatment. The vehicle must be collected within business hours on the agreed completion day unless overnight storage has been booked in advance. If a vehicle is not retrieved within 24 hours of notification, a secure indoor storage fee of €25.00 per calendar day will be charged.
§ 7 Warranty Rights & Defect Notification (§ 634 BGB)
The statutory warranty provisions of the German Civil Code (Bürgerliches Gesetzbuch - BGB) apply. The customer is requested to inspect the vehicle immediately upon collection. Any apparent deficiencies must be reported to the studio manager prior to driving off the premises so an immediate touch-up or remedy can be performed.
§ 8 Limitation of Liability
- Carwashh Shop GmbH is liable without limitation for intent and gross negligence, as well as for damage resulting from injury to life, body, or health.
- In cases of slight negligence, liability is limited strictly to the violation of essential contractual obligations (cardinal duties) and to typical, foreseeable damage.
- Liability for loose valuables, cash, or electronics left inside the car is excluded unless expressly deposited into our office safe upon arrival.
§ 9 Applicable Law and Place of Jurisdiction
These terms and all contractual relationships between Carwashh Shop GmbH and the customer shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant (Kaufmann), a legal entity under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin, Germany.
§ 10 Severability Clause (Salvatorische Klausel)
Should individual provisions of these AGB be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
